Defining Sexual Harassment
Defining sexual harassment is complex and complicated as trying to solve a law suit in the same manner is. Several gurus in law have tried to define this term; however, this kind of thing cannot be defined in black and white, and there will always be a few loose hanging threads.
Harassment is defined as continuously disturbing tormenting and troubling. Sexual harassment is harassment of a sexual nature towards somebody of the opposite sex or even the same sex.
In the law, sexual harassment violates Title IX in an educational setting and Title VII of the civil acts right in the workplace. Incase you find yourself in the situation where you have been harassed sexually; here are a couple of steps you can take to ensure that justice is carried out against the culprit incase it is a sexual harassment in the educational environment:
* Sexual discrimination is not allowed as per Title IX of the 1972 education amendments for education institutions that get federal funding. * Within the Department of Education, the Office for Civil Rights recognizes sexual harassment in the education environment in two forms: quid pro quo and hostile environment. That of a hostile environment is for unwelcome sexual advances to students or employees. Quid pro quo is when a member of staff suggests to a student that his or her educational decisions will be based on his or her consent to a sexual relationship of some kind. * Once you are familiar with all these, file a complaint with the (OCR) Office for Civil Rights in the Department of Education. This can be done online by visiting their official site and filling out a form. * OCR accepts hard copy complaints at Washington DC office. You will be required to provide your name, address, phone number, description of your title and the person who is doing the sexual harassment. Also, the name of the institution where the harassment takes place and a detailed description of how this happens will be required. * You will then be requested to stay in touch with the OCR as they carry out their investigations. During this process of investigation, the employees of the particular educational institutions may have to be given training on basic matters concerning sexual harassment, its negative effects and what steps they can take when they are experiencing the same or when a student approaches them with this problem. Sometimes when the case involves immigration related matters, it may end up being a question for immigration lawyers.
